Summit Realty Media - Terms and Conditions (Revised)

Please read these Terms and Conditions ("Terms") carefully before using the services of Summit Realty Media ("us", "we", or "our"). Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all clients, visitors, and others who access or use our services.

By booking our services, you agree to be bound by these Terms.

1. Services Summit Realty Media provides professional real estate media services, including but not limited to 3D virtual tours, HDR photography, and videography (collectively, the "Services"). All services will be performed in a professional and timely manner.

2. Booking and Scheduling

• Appointments: Appointments are scheduled on a first-come, first-served basis. Please book at least 48 hours in advance to ensure availability.

• Cancellations & Rescheduling: We require at least 24 hours' notice for any cancellation or rescheduling of an appointment.

  • Appointments canceled or rescheduled with less than 24 hours' notice will be subject to a cancellation fee of $75.

  • If our photographer arrives at the property and is unable to gain access or the property is not ready for the shoot, the full appointment fee may be charged.

• Weather: In the event of inclement weather preventing a shoot, we will work with you to reschedule for the next available date at no additional charge.

3. Property Preparation The client is responsible for ensuring the property is clean, staged, and ready for media capture at the scheduled time. Our staff will not be responsible for cleaning, decluttering, or moving furniture. A property that is not prepared may result in a suboptimal final product, and we are not liable for the outcome in such cases. Please ensure all pets are secured and do not interfere with the shoot.

4. Payment Terms (Updated)

• Upfront Payment: Full payment for the selected services is required at the time of booking through our online order page to secure your appointment.

• Confirmation: An appointment is considered confirmed only after payment has been successfully processed.

• Additional Fees: Any additional services requested on-site or fees for rush delivery will be invoiced separately and must be paid before the final media is delivered.

5. Copyright and Licensing

• Copyright Ownership: Summit Realty Media is the sole copyright owner of all media produced, in accordance with U.S. Copyright Law. All rights are reserved.

• Licensing Agreement: Upon full payment, the client who commissioned the work is granted a limited, non-transferable, non-exclusive license to use the media for the sole purpose of marketing the specific property for sale or lease.

• License Duration: This license is valid for the duration that the property is listed for sale by the commissioning client, or for a period of one (1) year from the date of delivery, whichever comes first.

• Prohibited Uses: The media may not be sold, gifted, transferred, or sub-licensed to any third party, including but not limited to another agent, broker, builder, stager, or the property owner. Any use of the media by a third party is a violation of copyright.

• Usage Rights: For commercial usage, portfolio use, or any use outside of marketing the specific property, please contact us for a separate licensing agreement.

6. Delivery of Media (Updated)

• Standard Delivery: Final media will be delivered electronically within 3-5 business days following the appointment.

• Rush Delivery: A 24-hour rush delivery service is available for an additional fee. This option must be selected and paid for at the time of booking.

• Hosting & Access: 3D virtual tours will be hosted on our platform for one (1) year. Digital photos will be delivered via a secure online gallery. It is the client's responsibility to download and securely store their media.

7. Limitation of Liability Summit Realty Media is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Our total liability for any claim arising out of our services is limited to the total fees paid by the client for the specific service in question.

8. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought in the federal or state courts located in the Dallas-Fort Worth metropolitan area.

9. Modification of Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website.
